  1. Chillin, the constitution says anything it does not address is left to the states and the people. This is the concept of federalism that our system of government is based on. The constitution addresses voting rights and segregation, these issues are not left to the states. The constitution does not address abortion.

  2. CHIP – “The constitution does not address abortion.” No, but case law (Roe v Wade) does. That’s also how our system of government works. The 2nd Amendment doesn’t mention shotguns or automatic rifles, but that doesn’t mean they aren’t protected by subsequent case precedence. See how that works?

  3. The Politico report said the justices voting to support Justice Alito’s opinion were Clarence Thomas, Neil M. Gorsuch, Brett M. Kavanaugh and Amy Coney Barrett. The news organization said Justices Stephen G. Breyer, Sonia Sotomayor and Elena Kagan were working on dissents. It was not clear how Chief Justice John G. Roberts Jr. planned to vote. So we pretty much know the court’s decision. And all the trigger laws in the deep red states just waiting to go when Roe turns – which will allow private citizens to sue someone getting an abortion, in some states will make it illegal to even talk or plan for an abortion – it will force female minors to carry unwanted pregnancies (even in cases of rape and incest in some) to full term, anyone driving a woman to get an abortion could be in trouble – some of the trigger laws require waiting even until it is unsafe for the mother in a medical situation to terminate the pregnancy. I’ve seen some here argue that “a lot of women are pro life etc” well that doesn’t mean one woman should have a say in another woman’s life. How anyone could feel this is ok by arguing “states rights” is abysmal.

  4. I think you unintentionally brought up a good point sac. Roe v wade established a “right” that is not described in the constitution. By contrast, the second amendment explicitly describes a right to keep and bear arms and second amendment court cases interpret the meaning, limitations, and historical context of this right. If the second amendment did not exist, then it would be up to the states to decide how they wish to regulate abortion. Similarly, if the constitution specified a right to abortion, which it does not, then the Supreme Court could interpret the meaning, limitations, and historical context of that right. The Supreme Court is not allowed to create rights that are not described in the constitution. With that in mind, the way to implement “roe v wade” would be to go through the process of amending the constitution.

  5. It’s also poking fun at the Supreme Court Justices who so often reference and discuss their own faith. We have separation of church and state, religion should have no part in any decision making but with a small evangelical subset of people who the GOP panders to, this is where we are heading.

  6. Chip: What a dense argument revealing how little you know about our system of government. Under your standard, individual states would be in charge of aircraft regulation and space exploration. I was entertained by the usual “states rights” garbage, now I’m just astonished.

  7. I think a lot of people are reading more into this leak than is justified. First, it’s important to note the court explores various options before reaching a final decision. There could well be other draft opinions taking very different positions that have not leaked, and the court has not yet made a final decision on this case. We won’t know what the court’s decision is until it is released next month. Second, this draft decision is not by any stretch a ban on abortion. The draft decision would leave it to states to decide how to handle abortion, as they did prior to roe v wade. In california and many other states, nothing would change.

  8. The “leaving it to states” conservative excuse is so old and ridiculous it’s laughable. What should we do about school segregation? Leave it to the states. Voting rights? Leave it to the states. We’ve all seen how that ends up.

  9. How many states would have a total ban on abortions?
    Even CA bans abortions beyond viability and there are only three states that allow abortion for any reason at any time in the pregnancy.
    A clear majority of Americans oppose most abortions that occur after 16 weeks and that number climbs rapidly from there.
    Texas has one of the most restrictive laws to take effect, but even there they allow abortion in the first 6 weeks.
    Personally, I do not think 6 weeks is enough time to find out about pregnancy and get an abortion and if it goes to a popular vote within texas would probably get extended to 12-16 weeks.
    Lawyers, lobbyists of all stripes are going to make a lot of $$$

  10. Link it to the right to get Viagra and watch no-abortion laws go away in a heartbeat. The loudest harrassers of the unintentionally pregnant are past-peak-reproductive time women and can’t-get-pregnant ever, men!

  11. Wasn’t slavery a state’s rights issue?!
    Leaving it to the states is not a solution, as it wasn’t to many other major American issues.
    Don’t like abortion? Don’t have one, or get a vasectomy.

  12. How so Chillin? Nothing is stopping the states from exploring space on their own and aircraft regulation has been codified on the federal level by acts of congress creating the FAA, NTSB, etc. (i.e. the same thing they could for abortion rights). It appears Chip isn’t the one that needs to brush up on our system government. i.e. our three separate branches of government, the judiciary isn’t the branch that makes the laws, and how our federal government was originally tasked with a very limited scope, increased via amendments and legislation over the years, with the intent that as much decision making as possible be left to the states.

  13. What we have here is a chip off the old banality of evil. If Roe v. Wade is overturned, women will die almost immediately … women in red states with ectopic pregnancies, which are invariably fatal with the only treatment being abortion. Not only are there states with no exceptions, they have added explicit clauses to their laws banning abortion to treat ectopic pregnancies. Wealthy women will hop on a plane, but 50% of women seeking abortion services are below the poverty line.
