Santa Barbara County District Attorney Joyce E. Dudley announced today that a felony complaint has been filed against Rafael Vivanco, 20, of Lompoc, California. Mr. Vivanco is charged with two counts of Attempted Willful, Deliberate, Premeditated Murder in violation of Penal Code section 664/187 and two counts of Assault with a Semiautomatic Firearm in violation of Penal Code section 245(b). In addition, a Special Allegation of Street Terrorism in violation of Penal Code section 186.22(b)(1), a Special Allegation of Personal Use of a Firearm, pursuant to Penal Code Section 12022.5(a)(1), PC 12022.53(b), a Special Allegation of Personal and Intentional Use of a Firearm Causing Great Bodily Injury pursuant to Penal Code Section 12022.7, 12022.53(d), and a Special Allegation of a Prior Strike Offense pursuant to Penal Code section 1192.7(c) were also alleged. These charges are in connection with a September 11, 2021 shooting in Lompoc that resulted in injuries to two victims.
Mr. Vivanco will appear in Department 9 of the Santa Maria Superior Court for arraignment on the above charges on September 14, 2021.

On 9/11/21 at approximately 9:30pm, Lompoc Police Department responded to a report of a shooting in the 500 block of North M Street. Officers located a 35-year-old male with a single gunshot wound. Officers provided first aid until other emergency services arrived and he was transported to an area hospital where he was listed in critical condition. A 31-year-old male was also struck by gunfire and arrived at the Lompoc ER with a non-life threaten injury.
Rafael Vivanco, 20-years-old, was located a few blocks away from the shooting and taken into custody after a short foot pursuit. A firearm was recovered in Rafael Vivanco’s possession. Rafael was booked into Lompoc Jail on the below charges: 664/187 PC – Attempted Murder |
