  1. Why charge a misdemeanor, entering the business to steal merchandise valued at less than $950 and not a felony burglary (459), entering to commit a theft. Both crimes require entering with intent to steal. Felony burglary only requires entering with intent to steal property and no minimum/maximum value is attached. Appears it would be easier to prove the felony. How is intent proven without talking to the suspect?
